1. About these Terms

These Terms of Service (the "Terms") govern the contract between Jobaria's operator ("Jobaria," "we," "us," or "our") and an individual consumer who creates and uses a Jobaria account ("you" or "your"). The operator's identity and contact details are provided in Section 16, “Contact.”

Jobaria is intended for individual users in the European Union and European Economic Area. It does not currently target the United Kingdom or business customers.

The contract is formed when you create an account after being given access to these Terms and agreeing that they apply. Visiting Jobaria's public website without creating an account does not by itself form this contract.

You must be at least 18 years old and have legal capacity to enter into this contract. If you do not meet these requirements, you may not create or use a Jobaria account.

Our Privacy Policy explains how Jobaria processes personal data. It is a privacy notice, not a request for consent and not part of these Terms. Where consent is legally required for a particular activity, Jobaria will request it separately.

2. The Service and early access

Jobaria provides tools that help individual users create and manage career profiles, build and analyze resumes, prepare cover letters, import and process job information, and use AI-assisted career and document features (the "Service"). Jobaria does not submit job applications or make hiring decisions for employers.

The Service is currently an early-access product provided free of charge. Early-access features may be incomplete and may change as the Service develops. This description does not exclude or reduce any mandatory statutory rights.

Jobaria may offer paid plans or paid features in the future. Before you place a paid order, Jobaria will provide the applicable price, billing period, included features, contract duration, renewal and cancellation conditions, withdrawal information, and any additional terms required by law. You will not be charged unless you expressly place a paid order. A free account will not automatically become a paid account.

3. Accounts and account security

You must provide accurate and current account information and update it when necessary. You may not impersonate another person, create an account for a person without authority, or transfer your account to someone else.

You must take reasonable steps to protect your credentials and devices and must not disclose authentication credentials or session access to another person. If you believe your account has been accessed without authorization, contact [email protected] promptly.

You may choose to authenticate through a supported third-party login provider. Your relationship with that provider is governed by the terms applicable to your provider account. Jobaria remains responsible for its own obligations relating to the Service and does not exclude liability merely because an incident involves a third-party provider. Your responsibility for losses caused by a failure to protect your account is determined under applicable law and the circumstances of the incident.

4. User Content and generated content

"User Content" means resumes, cover letters, profile information, job descriptions, instructions, notes, files, and other material that you submit to or create through the Service.

As between you and Jobaria, you retain the rights that you hold in your User Content. You must have the rights or other legal permission needed to submit User Content and to instruct Jobaria to process it. Personal data is not transferred to Jobaria as property, and nothing in these Terms limits your data-protection rights.

To the extent that permission under copyright or another content right is needed to operate the Service, you grant Jobaria a non-exclusive, worldwide, royalty-free licence during the contract to host, store, copy, format, parse, transmit, display, and otherwise process User Content only:

  1. to provide the features you request;
  2. to maintain, secure, troubleshoot, and support the Service; and
  3. to permit service providers acting for Jobaria to perform those activities on Jobaria's behalf.

The licence ends when the relevant content is deleted or the contract ends, except to the limited extent that continued retention or processing is permitted or required under the Privacy Policy and applicable law. This licence is limited to contractual content rights and does not replace any legal basis, information, or consent required under data-protection law.

To the extent Jobaria holds transferable rights in an AI-generated output created for you, Jobaria grants you a non-exclusive, worldwide right to use that output for lawful personal and professional purposes, including applying for work. AI-generated material may not qualify for intellectual-property protection, may not be unique, and may resemble material generated for other users. You remain responsible for reviewing an output before using or publishing it and for respecting third-party rights.

5. Jobaria's intellectual property and your right to use the Service

Jobaria and its licensors retain their rights in the Service, including its software, interfaces, workflows, documentation, templates, brand assets, and other protected material. References to Jobaria's rights include rights licensed to Jobaria by third parties; Jobaria does not claim ownership of third-party fonts, libraries, or other licensed material.

For the duration of the contract, Jobaria grants you a limited, non-exclusive, non-transferable right to access and use the Service for your lawful personal career activities in accordance with these Terms. This right does not permit you to resell, white-label, sublicense, or make the Service or its templates available as a competing product. You may use and share documents and other outputs created for you in connection with employment, self-employment, or other lawful professional activity.

Jobaria's names, logos, and brand assets may not be used in a way that suggests sponsorship, endorsement, or affiliation without prior permission.

6. AI-assisted features

Jobaria uses automated and AI-assisted tools to parse documents, structure career information, analyze user-provided material, and produce suggestions and drafts.

AI systems operate probabilistically. Generated or parsed material may be incomplete, inaccurate, outdated, unsuitable, or inconsistent. You should review and, where necessary, correct resumes, cover letters, career information, job information, scores, and other output before relying on it or sharing it with another person.

Jobaria's suggestions, document scores, and applicant-tracking-system compatibility indicators are estimates intended to assist you. They do not guarantee compatibility with a particular employer's systems or processes.

Jobaria is not an employer, recruitment agency, legal adviser, or immigration adviser. It does not decide whether an employer interviews, hires, or rejects you and does not guarantee interviews, job offers, employer responses, compensation, or career advancement. Jobaria does not make solely automated employment decisions about you or submit applications to employers on your behalf.

7. Acceptable use

You may use the Service only lawfully and in accordance with these Terms. You must not:

  1. use the Service to create or distribute deliberately false or fraudulent credentials;
  2. access another person's account or personal data without authorization;
  3. introduce malware or attempt to compromise, probe, evade, or disrupt the Service's security, access controls, or rate limits;
  4. use automated requests in a manner that materially overloads, damages, or interferes with the Service;
  5. use the Service or exported material to send unlawful spam or other unlawful communications;
  6. resell, white-label, or provide unauthorized access to the Service as a competing or third-party service; or
  7. copy, decompile, or reverse engineer the Service except to the extent that the activity is expressly permitted by mandatory law and cannot lawfully be restricted by contract.

Jobaria will apply these restrictions proportionately, taking into account the nature and seriousness of the conduct and any risk to users, third parties, or the Service.

Jobaria uses service providers for functions such as hosting, authentication, document processing, AI-assisted processing, email delivery, and error monitoring. The categories of recipients, the information normally disclosed to them, and applicable international-transfer information are described in the Privacy Policy. Use of a provider by Jobaria does not by itself create a direct contract between you and that provider.

If you choose a third-party login service or follow a link to an employer, job board, or another external service, the third party controls its own service and may apply its own terms and privacy notice. Jobaria is not responsible for an external service merely because the Service links to it. This does not limit Jobaria's responsibility for its own selection, instruction, or use of service providers where applicable law makes Jobaria responsible.

9. Availability and changes to the Service

Jobaria aims to keep the Service available and secure, but maintenance, security incidents, provider failures, and circumstances outside Jobaria's reasonable control may cause temporary interruptions. Jobaria does not promise uninterrupted availability unless expressly agreed. Your mandatory rights concerning availability, conformity, security, updates, remedies, and damages remain unaffected.

Jobaria may update the Service to maintain security and conformity, comply with law, address abuse, adapt to changes in technology or third-party services, improve performance or usability, or add and develop features. For a continuously provided digital service, a change going beyond what is necessary to maintain conformity will be made only where these Terms provide a valid reason for it, the change imposes no additional cost on you, and you are informed clearly.

If such a change materially impairs your access to or use of the Service, Jobaria will notify you within a reasonable period before the change on a durable medium and explain the change, when it will occur, and any statutory right to end the contract without charge. Statutory exceptions for minor impairments or continued access to an unchanged version remain unaffected.

10. Contract duration, suspension, and termination

The contract runs for an indefinite period until you or Jobaria ends it.

You may end the contract at any time by deleting your account through the account settings. Account deletion currently disables access and revokes active authentication, but it does not automatically erase every account-linked record and file. To request erasure of personal data, contact [email protected]. Jobaria will assess the request under applicable data-protection law and the exceptions described in the Privacy Policy. Ending the contract does not limit statutory rights to receive eligible content or exercise data-protection rights.

Jobaria may temporarily restrict access where reasonably necessary to protect users or the Service, investigate suspected fraud or abuse, prevent imminent harm, or comply with law. Where legally and operationally possible, Jobaria will explain the reason and the steps available to restore access.

Jobaria may terminate the contract for a material breach after giving you notice and a reasonable opportunity to correct the breach. Prior notice or an opportunity to correct is not required where the breach is so serious that immediate termination is justified, where correction is impossible or refused, or where immediate action is required by law or necessary to prevent material harm.

Jobaria may discontinue the free Service or terminate an account without fault by giving at least 30 days' notice by email. A shorter period may apply where continued provision becomes unlawful or is prevented by an urgent security or technical requirement outside Jobaria's reasonable control. Where reasonably possible, Jobaria will allow you to retrieve available User Content before access ends.

Provisions that by their nature are intended to continue after termination, including provisions concerning intellectual-property rights, accrued claims, and liability, remain applicable.

11. Statutory rights and liability

Nothing in these Terms excludes or restricts mandatory consumer rights, including applicable rights concerning the supply, conformity, security, updating, and modification of digital products.

Jobaria is liable without limitation:

  1. for intentional conduct and gross negligence;
  2. for death, personal injury, or damage to health caused intentionally or negligently by Jobaria, its legal representatives, or persons used to perform its obligations;
  3. under the German Product Liability Act;
  4. where Jobaria has expressly assumed a guarantee or fraudulently concealed a defect; and
  5. in any other case in which liability cannot lawfully be excluded or limited.

For damage caused by slight negligence, Jobaria is liable where it breaches an essential contractual obligation whose performance is necessary for the contract and on which you may ordinarily rely. In that case, liability is limited to damage that was typical and reasonably foreseeable when the contract was formed. This limitation does not apply to the cases listed above.

The limitations in this section also apply to Jobaria's legal representatives, employees, and persons used to perform its obligations. They do not change the allocation of the burden of proof required by law.

The explanations in Sections 6 and 9 describe the nature and limitations of the Service. They do not exclude liability or statutory remedies where Jobaria fails to meet an applicable legal or contractual obligation.

12. Responsibility for breaches and User Content

Each party is responsible under applicable law for loss it culpably causes by breaching these Terms or another legal obligation. You may be responsible for substantiated third-party claims caused by User Content or conduct that you knew, or should reasonably have known, was unlawful or infringed another person's rights. This section does not impose a duty to defend Jobaria, require advance payment of legal fees, or make you responsible for conduct attributable to Jobaria.

13. Changes to these Terms

Jobaria may amend these Terms where reasonably necessary because of a change in law, a binding regulatory or court decision, security or abuse risks, changes to the Service or its technical environment, or the introduction of new features. A change must not alter the essential nature of the contract or unreasonably disturb the balance between the parties.

Jobaria will provide the revised Terms and their effective date in a clear form. If a change materially disadvantages you, Jobaria will normally notify you at least 30 days before it takes effect by email or another durable medium and explain your right to end the contract before the change takes effect.

Continued use will not be treated as consent where applicable law requires express agreement. A change will not apply retroactively to conduct or claims arising before its effective date. Any special statutory rules governing changes to continuously supplied digital products remain unaffected.

14. Governing law and courts

These Terms are governed by German law. If you are a consumer who habitually resides in another country, this choice does not deprive you of the protection provided by mandatory provisions of the law that would apply without this choice.

Jurisdiction is determined by applicable law. In particular, nothing in these Terms restricts a consumer's right to bring proceedings before a court that has jurisdiction under mandatory consumer-protection rules. Jobaria will bring proceedings against a consumer only before a court permitted by those rules.

15. Consumer dispute resolution

The operator is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
